Terms of Service

These terms are an agreement between you and RJ Dowell, the individual who independently develops and operates Vitells, formerly called Vitals (“Vitells”, “we”). Vitells is not operated by any company or employer. By creating an account or using Vitells, you agree to these terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old and able to form a binding contract.

2. Not medical advice

Vitells provides educational wellness information about your own data. It does not diagnose, treat, cure or prevent any disease, and it is not a substitute for professional medical care. Never start, stop or change medication or treatment based on Vitells.

Emergencies: Vitells is not for emergencies. If you think you may have a medical emergency, call 911 or your local emergency number immediately.

3. Early-stage, free service

Vitells is an early-stage product and is currently free. Features may change, be incomplete or be unavailable, and we may modify or discontinue them. If we ever introduce paid features, we'll tell you first and you won't be charged without agreeing. Demo content is fictional. Product listings are fictional examples and are not offered for sale.

4. Your account

You're responsible for activity on your account and for keeping your Google sign-in secure. You may delete your account at any time from Settings.

5. Your data and privacy

You keep ownership of your data. You give us permission to store and process it only to provide Vitells to you, as described in the Privacy Policy. In short:

• We store your data with Supabase, run the app on Vercel, and use Google for sign-in.
• Health data is stored only with your explicit consent, and only you can access it.
• Garmin data is never sent to any AI service.
• You can withdraw consent, disconnect Garmin and delete your data or account at any time.

6. Connected services, including Garmin

• You can choose to add data from third-party services such as Garmin and Apple Health. Garmin data is added by importing a file you export from your own Garmin account or, for accounts we invite, through an automatic connection you authorize on Garmin's site; Apple Health data is added through the Vitells iPhone app, for accounts we invite. Your use of those services is governed by their own terms. Connect only accounts you own and are authorized to use.
• Garmin, the Garmin logo and Garmin Connect are trademarks of Garmin Ltd. or its subsidiaries. Vitells is not affiliated with or endorsed by Garmin.
• Data received from Garmin is provided “as is”. To the fullest extent permitted by law, Garmin and its affiliates make no warranties to you about that data or their services, and are not liable to you for any damages arising from your use of Vitells or of data provided through Garmin's services. Garmin and its affiliates are intended third-party beneficiaries of this section.
• You can disconnect a service at any time. Disconnecting Garmin deletes the Garmin data Vitells holds.

7. Acceptable use

Don't misuse Vitells: no unlawful use, no attempting to access other people's data, no interfering with or reverse-engineering the service, no automated scraping, and no uploading of content you don't have the right to share. Report abuse to rdowell1@gmail.com.

8. Disclaimers

Vitells is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose and non-infringement. Wearable data can be incomplete or inaccurate.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, health outcomes or decisions made based on Vitells. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these terms limits liability that can't be limited by law.

10. Ending your use

You can stop using Vitells and delete your account at any time. We may suspend or end access if you breach these terms or if we discontinue the service. Sections 5, 6 and 8–12 survive.

11. Changes

We may update these terms. We'll post the new version here with a new date and, for material changes, notify signed-in users. If you continue using Vitells after a change, you accept the updated terms.

12. Governing law and contact

These terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law rules, except where the law of the place you live gives you consumer protections that can't be waived. Contact: rdowell1@gmail.com.
